Social dilemmas of resocialization of conditionally released

The diploma thesis deals with dilemmatic situations, which are solved by conditionally released individuals. It is primarily aimed at gaining and retaining employment and the resulting dilemma. The first part deals with the theoretical description of the process of reintegration of prisoners, the factor of work in the prison and the activities of the Probation and Mediation Service during parole. The next part of the work focuses on employment, reintegration tools and the dilemmatic situation of parole prisoners. In order to describe the dilemmatic situations that the target group experiences during the acquisition of the work, these were conducted in a sample of three informants as part of the survey using semi-structured interviews. As a result, several major dilemma situations have arisen. Quotations from interviews with informants are reflected in the work findings from the literature dealing with the issue of employment of people after serving a sentence of imprisonment. In the past, many researches have described dilemmas and dilemmatic situations that a probation officer or other parole worker. However, this work aims to point out the dilemmas that specifically address conditional release.
Actual problems of social work during parol

This bachelor thesis deals with current problems in social work during parole. It aims to describe the current situation of parole in the Czech Republic. At the same time, the thesis pays attention to the naming and description of current issues, including finding relevant opinions and attitudes of workers operating within this specific activity. Research work aims at formulating certain optimization recommendations for further activity of Probation and Mediation Services in the Czech Republic. The theoretical part describes current trends in prison system as well as individual activities of probation workers within parole. The research part consists of qualitative research using the method of open-questioned structured interviews that are then being used to analyse interviews with the workers of Probation and Mediation Services in South Bohemia, Prague, and Hradec Králové. Via research, it was found out that the workers of Probation and Mediation services understand the following things to be problematic: great amount of administrative work, no respect for certain recommendations meant for the courthouse, and employing prisoners. Simultaneously, it was found out that those on conditional release do not perceive any relevant problem when cooperating with Probation and Mediation Services. Based on these results, solutions and recommendations have been designed for the purposes of probation officers´ work in the future, the application of which should make some work easier for the officers. Further, some solutions have been designed to problems in employing individuals on conditional release. These solutions include simplifying administration, greater respect towards probation officers from the courthouse´s side as well as greater awareness of potential employers of individuals on conditional release.
Systemic and Translation Equivalents of German Adjectives Ending on -frei and -los

This thesis uses language corpora to analyze Czech translations of a linguistically asymmetric phenomenon of German privatives ending in -frei and -los from three perspectives: translation typology (micro-stylistics and macro-stylistics), Popovič's stylistic adequacy (shifts of expression: intensification of expression, attenuation of expression, correspondence of expression) and potentially intrinsic feature of German privatives to perceive the fact of absence ("privation") as positive or negative. Privatives are adjectives that express the absence of substance or quality that is represented in their first (left) component; in the context of this work they are limited to adjectives ending in -frei, -los, -arm and -leer. In the Introduction the current state of research is outlined and its time and local limitations are explained. It is emphasized that corpus is here used not just for translation as such but also for theory of translation. The hypothesis starts from the assumption that German privatives as phenomena of grammar have no equivalent on this level in Czech; therefore a direct translation equivalent is often missing. For this reason it is also probable that the translator will have to decide for such Czech translation of one German privative that comprises more words or even a whole...

Do Constitutional Court's rulings bind lower courts? Doctrinal and empirical perspectives Abstract Czech doctrinal researchers conclude that decisions of the Czech Constitutional Court are - at least in some respect - bind lower courts pro futuro. Although continental legal systems do not officially subscribe to a doctrine of precedent, a quasi-precedential role of the jurisprudence of higher courts is often defended by theorists. However, this theory of quasi-precedent has never been empirically tested in the Czech Republic. This dissertation constitutes a first such attempt as it examines whether courts actually decide in practice according to the jurisprudence of the Czech Constitutional Court. Specifically, it focuses on a guideline decision by the Czech Constitutional Court on parole decisions made in 2018. The guideline decision emphasized that parole decisions - made by courts in the Czech legal system and not by parole boards or committees - constitute a systemic problem since they are poorly reasoned and as a result they are ambiguous and not persuasive. Social stabilization clients with probation supervision imposed

The thesis focuses on the socio-educational work methods of the probation and mediation services and of its workers in relation to their clients with imposed probation supervision and on the opportunities for development and support of their healthy social functioning. The thesis is divided into theoretical and practical part. In the theoretical part initially are defined the basic concepts and terms, then it is described the target group of conditionally released from prison clients, which currently are under supervision of a probation officer. The thesis sees the imprisonment as a difficult life situation and it deals with the influence of penitentiary environment on the personality of the convict in relation to his further development. In the second part are described the specific activities of the probation and mediation service workers in relation to clients from the target group. The thesis focuses on the socio-educational work of the probation officers, as well as social workers or other organizations for social prevention and their impact on the social stabilization of individuals, belonging to the target group. The theme of my diploma thesis is the efficiency of the probation supervision of the system of justice. My aim is to inform wheather and in which way the probation supervision helps to reduce the risk of crime's relapse. This diploma thesis is divided into two parts. The first one is theoretical whereas the second one is practical. In the theoretical paragraph I explain the aims and reasons of probation supervision. The wide scope of taking advantages of this care is also mentioned. I describe all activities connected with the above. The pecularities of youngters's probation supervision are pointe dout, as well. Last but not least I inform about the course of the probation supervision and try to compare alternative sanctions to the imprisonment. A statistic survey of probation supervision in last few years makes a part of my thesis, too. The second part of my thesis is based on my practice in the centre of probation and mediation care. I mention the results of my research among the members of the working team in the above organisation and social worker's for youngsters and adults. Rehabilitation and reintegration of people conditionally released from prison.

Abstract The extensive name of this thesisResocialization and Integration of Conditionally Released People from an Imprisonment means here monitoring of these people experience with getting job and potential employers willingness and causes which defend their admission to work. The theoretical part is divided into five chapters, where I try to clarify the important key words , describe a preparation for resocialization and integration in prison , deal with a status and opportunities of prisoners´ employment in the Czech Republic. I show the statistic as well as state organizations and NGOs care and help offers for conditionally released people. Finally I introduce some of reintegration and resocialization projects in the Czech Republic in conclusion of the theoretical part. The empirical part includes the research itself and it is divided into two parts. I performed the first one on the research sample of six conditionally released people under the probation supervision using qualitative research method, method of questioning and semi-standardized interview technique. Because of my interest of employers attitudes to former prisoners employment, I made the research with 20 employers from Prachatice region using the same methods and technique. The main goal of this research was to find former prisoners´ expectations dealing with getting job. The results showed, that these people expect assistance from family, friends, an labour office as well as from PMS or other organizations, e.g. NGOs. One of my research fractional aims was to find the expectations related to The Labour Office. The results showed nearly half of the respondents did not expect anything, however some of them expect the offer of retraining or vacancies. To find out willingness of employers to give a job to former prisoners was the goal of the second part of empirical research. The results of this research show that the vast majority of respondents would give a job to these people but only those positions, where the material responsibility is not required. This thesis shall provide insight into the problems of conditionally released people who try to find a job and integrate into society. On the other hand it shows potential employers and state or non-state organizations attitudes.
The punishment of homeprison as a form of the offender´s rectification

Each human society creates during its existence a system of reactions against undesirable activities of persons, who break the rules of the smooth passing of a particular community and contravene the standards and values of the community. The view of these reactions {--} punishments, changes over time and also with a respect to culture of the community or the state and its approach to an individual and his rights. In the past, the forms of punishments were, and in some countries still are, mainly primitive, such as amputations of body parts. However, the civilised world, especially, in case of non-arrestable offences, tends to prefer non-custodial service, such as home detention. Home detention as a form of penalty has been used in various alternatives for many years in countries such as Italy, Germany etc. However, the Czech legal system did not allow to impose this penalty until 2010. This form of penalty should facilitate the situation in Czech crowded prisons. It might be imposed on thousands of the sentenced a year and, at the same time, it would save money of the tax payers. The thesis deals with the legislative framework, where the home detention belongs and it is also focused on the fact how the other states, where home detention has been applied for years, have adopted this form of penalty. The objective of the Probation and Media Service of the Czech Republic is also mentioned in this work. The theoretical part of the thesis is divided into two parts {--} the first part deals with the punishment in general, the other one is focused on home detention in particular.
The work of Probation and Mediation Service with a group of people on parole and under police supervision

The present bachalor{\crq}s thesis titled The work of Probation and Mediation Service with a group of people on parole and under police supervision deals in detail with the activities of the said institution in the Czech Republic. Long-term sentence have no positive results, therefore alternatives are being sought, alternatives that would replace traditional forms of criminals´ punishments. A large contribution has been seen in activities carried out by the staff of Probation and Mediation service. Thanks to it, many of those condemned are allowed to accept another/alternative form of punishment apart from imprisonment. Theoretical part of the thesis gives an account of the activities performend by Probation and Mediation Service in the Czech Republic, it describes its origins, organizational structure, principles, objectives, and function. The thesis also dwells on some projects the Service is participating on and which are essential for reintegration of the people released from prison. The research part of the thesis presents a quantitative survey that employed a method of questioning using the technique of semi-standardized (semi-conducted) interview, and a method of content analysis using the technique of secondary data analysis. The surveyed group contained the total of 15 clients of Probation and Mediation Service in České Budějovice. The aim of this work was to find out whether the people released on perole have a chance to come back to their original family bacgrounds, if they can find jobs and shelters, the impact of the punishment on the family as a whole, the amount of information they have, and the positive and negative aspects they saw in being sentenced and sent to prison. The findings of the survey are as follows: If the prisoners released from prison heve a functional family background even befor they started their imprisonment, they are welcome to come back even after having been released from prison. Upon their release, they tend to find some dwelling and proper job. The least negative impact has been detected in connection with relations between parents and children, noticeably negative impact has been observed in connection with relationships between partners. The amount of economical information provided for people released from prison is insufficient. The positive aspects of imprisonment include lessons the prisoners learn from their mistakes, and tendency to emphasize family relations. The negative aspects of imprisonment include mainly damaged family relations, the loss of a close person, the feeling of life loos, and stigmatization.
